Special Education Litigator
Matthew McCann
Matt McCann is a special education litigator who focuses his practice on helping children with special needs and their families secure a free appropriate public education in and through the New York City School system. He practices both at the administrative level working within the DOE’s process to secure appropriate education and services for students as well as in federal court bringing actions when the DOE has not lived up to its obligations or when there are systemic issues which need attention.
He is the proud father of two sons, the younger of whom has significant special needs and was his inspiration to switch to this field of the law. In his current practice, he draws on his 13 years or prior experience as clerk for a federal appellate court and a white collar criminal and complex commercial litigator. Matt has been selected as a Super Lawyers’ Rising Star (2015-2019) and Super Lawyer (2020) in the New York Metro Area in White Collar Criminal Defense, Employment Litigation, Business Litigation, and Education Law. He has maintained as Martindale-Hubbel 4.9/5.0 AV® Preeminent rating since 2015.
His articles on securities law, white criminal defense and administrative law have been published by LexisNexis and the American Bar Association. Matt has been an active member of the New York City Bar, the American Bar Association and the Nassau County Bar Association, in all of which he has held leadership positions. He is also an Adjunct Professor of Legal Writing at his alma mater, Brooklyn Law School. and has been an instructor as part of Hofstra University’s paralegal studies program.
Matt was a charter member of the first NYC chapter of Power Hour along with his friend and former colleague Mark Smith. He is happy to be rejoining the group as part of its second chapter after leaving the City to practice on Long Island for a few years.

I am committed to my clients and want my clients to be involved in their matters as much as they wish to be. A divorce or family matter is not only a legal matter but as it is extremely emotional time for the clients and since it is personal in nature it requires understanding on the part of counsel to know their clients needs and requirements. I spend a great deal of time talking to my clients getting to know what they need to move forward after their divorce is over. After twenty-five years practicing in the matrimonial area I can definitely say that listening to my clients is a priority and necessity. I truly believe that each client needs to be involved at every stage of his/ her case.
I enjoy being an advocate and while negotiation is preferable to litigation it is not always possible in all cases. I have extensive trial experience and have appeared in New York State courts and Federal Court. My trials have encompassed all phases of family law issues from custody, finances, equitable distribution, relocation, guardianship and domestic violence.
I am certified for appointment as an Article 81 guardian as well as an Attorney for Children in the First Department of New York State. I have represented many children in divorce cases over the past fifteen years
